HOUSTON — A couple alleges they suffered severe food poisoning after eating food from a Houston area Mexican restaurant.

Patricia Franco and Kelsey Franco filed a complaint  Jan. 31 in Harris County District Court against Texas Taco Cabana LP, T.C. Management Inc., and Fiesta Restaurant Group Inc., alleging liability, negligence and violations of the Texas Deceptive Trade Practices Act.

According to the Franco's complaint, they ordered dinner from a Taco Cabana located in Houston on March 26, 2020. They allege that after eating the steak fajita tacos from Taco Cabana, they suffered "intense stomach aches, cramps, "excruciating" abdominal pain, nausea, vomiting and headaches which required them to be hospitalized.

They further allege that since eating the food from Taco Cabana, they have been hospitalized several times and still suffer injuries from the food poisoning including Patricia Franco being unable to eat solid foods. The plaintiffs claim the defendant's negligence for serving unsafe and defective food products.

The Francos seek monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by M. Obaid Shariff of The Shariff Law Firm in Houston.
