Suit: Attorney failed to pay diagnostic, imaging facility that provided service for his personal injury clients

HOUSTON — A Houston attorney is being accused of breaching his agreement with a diagnostic testing facility that provided services for his personal injury cases. 

Memorial MRI & Diagnostic LLC filed a complaint  Jan. 30 in Harris County District Court against David Saenz alleging breach of contract, fraud and other claims.

According to Memorial's complaint, it performed healthcare services for Saenz's clients to help settle his clients' personal injury claims. They allege the agreement included Saenz paying for his client's healthcare bills once a claim was settled. 

Memorial further alleges that Saenz has settled many of his personal injury cases and received settlement payments without making a payment to them for the healthcare services they provided to his clients. 

They claim Saenz failed to honor their agreement and misapplied IOLTA trust account proceeds as well as committed fraud by making false representations through letters of protections that he would protect their medical bills. 

They also claim Saenz breached their letter of protection agreements and is liable for the healthcare services that were provided to his clients. 

The plaintiff seeks monetary relief, interest and all other just relief. They are represented by Phillip Brantley of Phillip Brantley and Associates PC in Houston.
