HOUSTON — A woman alleges her distracted Lyft driver caused her to suffer injuries.
Catherine Gebhardt filed a complaint Jan. 25 in Harris County District Court against Lyft Inc., doing business as Lyft Drives Texas Inc., and John Doe alleging negligence.
According to the complaint, Gebhardt, who is vision impaired, was a passenger of a Lyft driver on June 24, 2021. She alleges that as the Lyft driver stopped at her destination on Wilcrest Drive in Houston, the driver left the front wheels over a speed bump with the rear wheels which were not over the speed bump, just outside her rear passenger door.
Gebhardt claims she stepped on the side of the speed bump, which caused her to break her ankle. She alleges the driver's negligence for failing to provide a safe exit and for operating the vehicle while distracted with a cellphone.
She further alleges Lyft's negligence for its hiring of Doe and its failure to train and supervise its employees. Gebhardt also claims Lyft violated local, state and federal laws and regulations. She alleges she suffered pain, disfigurement, loss of earning capacity and incurred medical expenses as a result of the accident.
Gebhardt seeks monetary relief, interest and all other just relief. She is represented by Donald Kidd and Essay Eden of Perdue & Kidd in Houston.
