Man allegedly trips over protruding expansion joint in Gringo's parking lot, sues for $1M

HOUSTON — A man alleges he suffered serious injuries after tripping over a protruding expansion joint in the parking lot of a Katy restaurant. 

William Evans filed a complaint Feb. 8 in Harris County District Court against Gringo's Mexican Kitchen and Ybarra Franchising Group LLC alleging negligence. 

Evans, according to his suit, was at the defendants' restaurant on West Grand Parkway in Katy on Sept. 30, 2021. He claims that as he was leaving the restaurant and walking in the parking lot, he did not see an "unmarked wooden concrete expansion joint" that was protruding upwards between two concrete slabs. He further claims his right foot hit the joint and caused him to fall forward and crash down on the concrete and onto his left knee. 

Evans alleges the defendants' negligence for failing to inspect its parking lot, give adequate warning of the hazardous condition and for failing to make its premises safe. He also alleges the defendants failed to implement proper safety protocols or make the protruding joint safe. 

Evans seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Scott Armstrong and Teri Russell of Armstrong & Lee LLP in Houston.
