Construction worker sues after fall off ladder

HOUSTON — A worker alleges he was forced to lift heavy materials while on a ladder which caused him to fall and suffer injuries. 

Gustavo Carvajal-Perez filed a complaint Feb. 14 in Harris County District against Evesa LLC, H&S Design and Services LLC, David Rios, individually and doing business as Sinai Construction Services and others alleging negligence and premises liability. 

The plaintiff was working at a residential premises in Pasadena on Feb. 19, 2020, that was owned and operated by the defendants, according to his complaint. He claims that he was "forced" to lift heavy materials and equipment "while at height on a ladder" which caused him to fall. He further claims as a result of the fall, he suffered injuries to his back, neck and other body parts. 

The plaintiff alleges the defendants' negligence for failing to ensure the equipment was properly affixed and for their lack of supervision and training. He also alleges the defendants did not have adequate safety polices, warn of the dangerous condition, or follow proper emergency response and evacuation procedures and that they also failed to comply with state laws and regulations. The plaintiff claims the defendants were also negligent for retaining a contractor to complete activities that had a risk of harm. 

The plaintiff seeks monetary relief, trial by jury, interest and all other just relief. He is represented by Nicholas Morrow, John Sheppard and Patrick McGinnis of Morrow & Sheppard LLP in Houston.
