Tenant alleges wrongful eviction during COVID-19 eviction moratorium

HOUSTON — A tenant alleges water leaks in his apartment caused his personal property to be damaged and claims he was wrongfully evicted during the COVID-19 eviction moratorium. 

Ryan Schiebel filed a complaint March 7 in Harris County District against APT Towne Plaza LLC alleging negligence, breach of contract violation of the Texas Deceptive Trade Practices Act and other claims. 

According to his complaint, Schiebel leased an apartment from APT Towne beginning in October of 2018. He claims that water leaks in his unit caused him to have $8,187.47 in personal property damage to his computer, printer, his military sea bag, 10 sets of sheets, a leather couch as well as damage to his mattress and other furniture. 

Schiebel alleges the defendant's negligence in maintaining the apartment complex and claims he was also wrongfully evicted during a 2020 Covid-19 moratorium on evictions in violation of the Texas Deceptive Trade Practices Act. 

Schiebel seeks monetary relief of at least $25,562.41, interest and all other just relief. He is represented by Thomas Valega, Jr., of Thomas M. Valega, Jr., PC in Houston
