Property owner claims pool contractor failed to obtain proper permits

HOUSTON — A property owner alleges his pool contractor failed to obtain the proper permits and filed an invalid lien on his property. 

Carlos Manuel Reyes Conill filed a complaint March 21 in Harris County District Court against ABMA Inc., and Aurora AMK Inc., doing business as PLM Restoration also known as PLM Restoration & Remodeling alleging violation of the Texas Deceptive Trade Practices Act, breach of contract, negligence and other claims. 

According to his complaint, Conill hired the defendants to install an in-ground swimming pool on Jan. 15, 2021, for $73,464.87. He claims he made six payments of $8,800 each and was told the project would be finished on June 14, 2021. 

Conhill further claims the defendants falsely told him the required permits had been obtained and began to notice an "unreasonable delay in work" after the initial installation work began. He alleges that the color of the pool plaster was wrong, the patio concrete began to crack and that a day after the pool was filled, the copper piping had issues. Conill also alleges he was issued a $50 penalty by his homeowners association because the defendants failed to obtain proper approval for the exterior work on the property. 

Also according to his suit, Conill had to hire contractors to repair and complete the swimming pool project as well as to repair the damage done to his yard by the defendants. He claims the defendants also filed an invalid lien against his property in March of 2022. 

Conill seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Benjamin Sanchez of The Sanchez Law Firm in Houston.
