A Tennessee woman has filed a legal malpractice lawsuit against a Houston law firm, according to recent Harris County District Court records.
Joyce K. Mitchell alleges that Roberts Markland, LLP and one of its lawyers, Anjali Sharma, made misleading statements regarding their abilities to defend her.
The lawsuit, filed March 28 in the 165th State District Court, claims that the defendants informed Mitchell that they would handle her original lawsuit stemming from a car accident, despite the fact that they are not permitted to practice law in Mitchell's home state.
Sharma was reportedly appointed as Mitchell's legal counsel after she hired the responders back in 2019.
"Plaintiff was misled to believe that Roberts Markland LLP could handle her case in the State of Tennessee when in fact the firm could not," the lawsuit states.
The lawsuit claims that after the defendants told Mitchell they could represent her, the parties entered into a contract.
Additionally, the lawsuit alleges that Sharma misled Mitchell into believing that the issue was being dealt with properly.
Mitchell reportedly discovered later that the Tennessee statute of limitations on her lawsuit had expired due to the defendants' failure to take legal action on her behalf.
The court documents also state that Mitchell did not receive any letter notifying her of the statute of limitations.
'Plaintiff has been prevented from having her case presented for consideration of damages as a result of her personal injury," the original petition says.
As a result, Mitchell's Harris County lawsuit seeks an undetermined amount of monetary compensation.
