Electrical contractor who fell into four foot hole at Houston work site claims negligence

HOUSTON — An electrical contractor who fell into a four foot deep hole at a construction site in Houston and suffered disabling injuries is claiming negligence. 

Dane Kissoondath filed a complaint April 5  in Harris County District Court against EMJ Construction LLC alleging negligence. 

Kissoondath was working for IES who was an electrical contractor for EMJ Construction at a worksite in Houston on Dec. 18, 2021, according to his suit. He alleges that while entering the "pump jockey room or pump room," to assist two other electricians, he fell into a hole   that was approximately four feet deep and suffered injuries to his leg and other parts of his body. 

He claims his injuries have caused him to remain disabled and unable to perform his normal work activities. Kissoondath alleges EMJ's negligence for not marking, covering or barricading the area around the hole and that EMJ had been previously warned bout the dangerous hole. He further alleges the defendants were negligent for allowing the opening in the floor to exist in a dimly lit room in violation of OSHA regulations. Kissoondath also alleges EMJ's negligence for causing the deep hole to be built into the slab foundation. 

Kissoondath seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Edward Hennessy of The Hennessy Law Firm in Houston.
