Worker claims lack of safety measures at job site caused crane accident

HOUSTON — A worker who was injured due to a crane toppling over at a job site is claiming negligence. 

Eduardo Trevino filed a complaint April 4 in Harris County District Court against Maxim Crane Works LP and Lyondell Chemical Company alleging negligence. 

Trevino, according to his suit, was working at Lyondell's construction site on July 11, 2021. He alleges that a crane owned and operated by Maxim fell over, caused a chain reaction and caused another object to strike the structure he was working in which then toppled over. Trevino claims as a result of the accident, he suffered injuries to his neck and back. 

He alleges the defendants' negligence for failing to properly screen, hire and train crane operators, failing to operate their equipment in a safe manner and failing to have a safe work site for contractors. Trevino also alleges the defendants failed to enforce safety rules and guidelines or institute measures to protect those working at the site. He claims the defendants also knew or should have known of the risks associated with the construction work. 

Trevino seeks monetary relief of over $1 million, trial by jury, interest and all other just relief. He is represented by Anthony Buzbee and Christopher Leavitt of The Buzbee Law Firm in Houston.
