HOUSTON - The parents of the late Kianna Walker have brought a wrongful death lawsuit against Xtreme ATV Off Road and Beach.
The Houston Chronicle reported on the death of Walker earlier this year.
According to the lawsuit, on Feb. 5 Walker was riding as a passenger on an ATV with her boyfriend at Xtreme’s outdoor park in Crosby when the incident occurred.
“As a result of Defendant Xtreme’s negligent conduct, the ATV struck an unmarked dangerous condition on Defendant’s property causing the ATV to rollover on her,” the suit states. “Ms. Walker ended up dying around 5:00 in the afternoon that Saturday. She was only 25 years old.
“Her four-year-old son, J.G., her father, Michael Walker, and her mother, Rebecca Jimenez, all bring this lawsuit to determine what happened and to prevent other tragic deaths from occurring again at Defendant Xtreme’s property.”
According to the suit, Walker’s death does not appear to be an isolated incident of someone getting killed or severely hurt at Xtreme’s property. In 2020, an ATV rider was killed at the defendant’s park. Other customers were transported by Lifeflight after an ATV flip over at the defendant’s park in September 2019.
The lawsuit alleges negligence and gross negligence and seeks more than $1 million in damages.
Attorney Cody Dishon of The Ferguson Law Firm in Beaumont represents the plaintiffs.
The lawsuit was filed April 14 in Harris County District Court.
