HOUSTON – A Houston restaurant is facing a claim that its poorly lit premises caused a customer to fall and suffer multiple injuries.

Guadalupe A. Hernandez filed a complaint May 5 in Harris County District Court against The Moon Tower Inn alleging negligence.

Hernandez alleges in her complaint that while leaving the Moon Tower Inn on Canal Street in Houston on Sept. 5, 2021, she fell as a result of the poorly lit premises. She claims Moon Tower's negligence for failing to maintain its premises in a reasonably safe condition and for not having adequate lighting.

Hernandez also claims Moon Tower was negligent due to its failure to inspect or correct the hazard on its premises and did not warn of the dangerous condition.

In her suit, Hernandez also claims Moon Tower negligently trained and supervised its employees. She alleges as a result of her fall she suffered pain, disfigurement, impairment, lost wages and incurred medical treatment expenses.

Hernandez seeks monetary relief between $250,000 and $ 1 million, interest and all other just relief. She is represented by Thomas Bickham, Jr., and David Swick of Bickham Law in Houston.
