Trucking company worker alleges poor safety standards led to his injuries

HOUSTON — A trucking company worker alleges poor safety standards caused his thumb to be crushed while operating a crane machine. 

Josue Umanzor Fuentes filed a complaint May 13 in Harris County District Court against Selvin Trucking Inc., alleging negligence. 

Fuentes was working for Selvin on Sept. 9, 2021, according to his complaint. He claims that while activating a crane machine, he crushed his thumb due to the defendant failing to provide proper training, safety devices  and procedures. 

Fuentes also claims Selvin failed to inspect its equipment, warn of the dangerous condition and allowed vehicles and equipment in question to remain a hazard while failing to eliminate the dangerous condition. He alleges as a result of the accident, he suffered pain, disfigurement, impairment, loss of earnings and incurred medical treatment expenses. He also alleges the accident could have been prevented if proper safety procedures would have been enacted and enforced by Selvin. 

Fuentes seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Stephen Ricks, Javier Marcos, Jr., Lupe Pena, Nefi Lopez, David Ortez, Ryan Beason, Wade Moriarty and Isaac Bahena of The Law Offices of Marcos & Associates PC in Houston.
