Worker alleges unsecured metal sheets caused his job site injury, sues American Western Steel

HOUSTON — A worker alleges an unsecured metal sheet picked up by the wind which struck him caused severe injuries. 

Kevyn Ortega Lopez filed a complaint  May 13 in Harris County District Court against American Western Steel LLC alleging negligence. 

Lopez, according to his complaint, was working as an independent contractor for American Western Steel LLC at a job site in College Station on Oct. 28, 2021. He claims that while working at the site, a load of metal sheets that had been delivered and had not been secured, was picked up by the wind, struck him and caused him to suffer injuries. 

Lopez alleges American Western's negligence for failing to inspect its worksite, failing to warn of the dangerous condition and failing to keep the worksite free of hazards. He also alleges American Western was negligent for not training its employees and subcontractors on securing worksite materials so that they do not create a hazard and for allowing the materials to be stored in a dangerous condition. Lopez claims as a result of his injuries, he suffered pain, impairment, loss of earnings and incurred medical care expenses. 

Lopez seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Stephen Ricks, Javier Marcos, Jr., Lupe Pena, Nefi Lopez, David Ortez, Ryan Beason, Wade Moriarty and Isaac Behena of The Law Offices of Marcos & Associates PC in Houston.
