Home Depot customer alleges contractor was allowed to use her store credit card without authorization

HOUSTON — A woman alleges Home Depot allowed a contractor to use her store credit card for unauthorized purchases. 

Sylvia Les-Sie filed a complaint May 16 in Harris County District Court against Plus Eight Designs LLC, Henry Nnabue and Home Depot U.S.A., Inc., doing business as The Home Depot, Inc., alleging breach of contract, negligence, theft and other claims. 

According to the plaintiff's complaint, she entered into a contract with Plus Eight for repair work on her home with an agreed upon price of $41,212. She claims that she paid a $6,000 down payment and that in July of 2021, Plus Eight purchased additional materials with her Home Depot credit card without her approval and without Home Depot contacting her to authorize the additional charges or release of the materials. 

The plaintiff alleges that Nnabue failed to perform the contracted repairs on her home and that he was "unjustly enriched" by Home Depot's failure to stop the unapproved purchases. She further alleges Home Depot's negligence for failing to follow its own policies and procedures by allowing the unauthorized charges. The plaintiff claims she has the loss of her down payment of $6,000, the costs of materials and has an outstanding balance for unauthorized charges on her credit card.  

The plaintiff seeks monetary relief of less than $250,000, interest, trial by jury and all other just relief. She is represented by Joseph Willie and Shalanda Moore of Willie & Associates PC in Houston.
