Suit: Houston car dealership illegally acquired, sold man's truck

HOUSTON — A Harris County man alleges a Houston car dealership illegally acquired his truck without him signing over the title.  

Fidencio Lerma filed a complaint June 8 in Harris County District against House of Diesel LLC alleging theft and conversion. 

Lerma alleges in his complaint that he purchased a 2017 GMC Sierra 1500 regular cab from House of Diesel on Feb. 20, 2020, for $29,744.69. He claims he made a $15,000 down payment with an agreement to make three monthly payments of $4,978 for the remaining balance and fully paid for the vehicle and received title on May 8, 2020. Lerma alleges that in December of 2020, his son raffled the vehicle without his authorization and that the person who won the vehicle sold it back to the defendant. 

He claims he never signed the title of the vehicle over and the defendant purchased the vehicle without title and may have already sold the vehicle. He further claims House of Diesel had wrongful custody of the vehicle and has failed to return the truck.

Lerma seeks monetary relief of $250,000 or less, interest, trial by jury and all other just relief. He is represented by Benjamin Sanchez of The Sanchez Law Firm in Houston.
