Elderly couple sue John Moore Services, allege botched air conditioning repair caused home to burn down

MONTGOMERY COUNTY – An elderly Montgomery County couple is suing John Moore Services, Inc., on claims the business engaged in deceptive trade practices that caused their home to catch on fire. 

Plaintiffs Anthony Black and Terry Black filed the suit against John Moore Services, Inc. in the Harris County District Court, citing negligence, breach of contract, fraud, and deceptive trade practices.

According to court documents, the Blacks contracted with the defendant last year to fix their air conditioning system, which gave out a decade after it was installed. A representative with John Moore purportedly told the couple a new compressor and coil was needed.

The plaintiffs eventually agreed on a financing plan to have the parts installed. The suit says that after the work was completely earlier than expected, the Blacks noticed that smoke was filling their home. A fire then forced them to leave their family home.

The lawsuit states that the plaintiffs' home sustained more than $200,000 in damages, and that damage to the plaintiff's personal property was more than $100,000 and the couple has been forced to live in a small apartment while their home is under repair. Exacerbating the ordeal was Anthony's poor health. According to the suit, he had suffered a stroke in April of 2021 causing major paralysis in much of his body and forcing him to rely on a wheelchair. The home undergone major modifications to accommodate his needs.

According to the lawsuit, the home was insured and the insurer will cover most of the damages. 

The plaintiffs are seeking damages in excess of $1,000,000 for pain and suffering, mental anguish, stress, loss of their enjoyment of their home while it is being repaired, loss of property value, interest, attorney fees, court costs, and any other relief the court deems proper. They are represented in this case by attorney Dale L. Trimble of The Trimble Firm, PLLC in Conroe.
