Suit alleges woman fell over unlit, unmarked stairs outside Hooters in Galveston

GALVESTON — A woman who fell down the stairs outside a Hooters restaurant in Galveston is claiming negligence. 

Deanna J. Neidig filed a complaint June 13 in the Galveston County 212th District Court against Hooters of America LLC alleging negligence and other claims. 

According to Neidig's suit, she was at a Hooters on Heards Lane in Galveston on Dec. 16, 2020. She alleges that as she was leaving the restaurant "on a dark" evening, she fell down the stairs and suffered injuries. Neidig alleges Hooter's negligence for failing to have lights on the outside of the restaurant and for not marking the stairs which created a hazardous condition. 

She further alleges that it was so dark on the outside of the restaurant that those who assisted her after her fall, had to use their cell phones as flash lights. Neidig claims Hooters' negligence for failing to warn of the hazard. 

Neidig seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Jose Orihuela of Orihuela & Associates PLLC in League City and Joe Zaid of Joe I. Zaid & Associates PLLC in Pasadena.
