Construction worker alleges nail gun misfire caused him to loose eye

HOUSTON — A construction worker who lost sight in one eye after a nail gun misfired is claiming negligence. 

Samuel De La Tejera filed a complaint June 25 in Harris County District Court against Jaime Garcia doing business as PTS Construction Services and Highland Homes LLC alleging negligence. 

Tejera, according to his complaint, was installing a door at a home construction project on May 18, 2022. He claims a nail gun misfired, bounced off the surface and struck him in the eye which has caused permanent blindness in his right eye. 

Tejera alleges the defendants failed to maintain and check equipment, failed to have any protective eye wear and other equipment and did not remove any hazards from the workplace. 

He also alleges the defendants were negligent for failing to keep him safe from injury, for not replacing the nail gun and for their failure to implement safety protocols. Tejera claims he also suffered lost wages, impairment and incurred medical expenses. 

Tejera seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Todd Webb of The Law Office of Todd E. Webb in Houston.
