Texas appellate court reverses Allstate’s summary judgment win in claims suit

HOUSTON - Yesterday, the 14th Court of Appeals reversed Allstate’s summary judgment win in a lawsuit brought over the insurer’s alleged failure to pay claims. 

In 2018, Cortney Hill, individually and as next friend of her son, D.M., filed suit against Allstate Fire and Casualty Insurance Company for allegedly failing to pay claims under an automobile insurance policy. 

Court records show Allstate filed a traditional and no evidence motion for summary judgment, which the trial court granted.

On appeal, Cortney Hill argued that the trial court erred in granting summary judgment because she raised a genuine issue of material fact regarding whether she and D.M. were covered individuals under the policy.

The 14th Court reversed the trial court’s order granting summary judgment as to both Cortney Hill and D.M., remanding the case to the trial court for further proceedings.
