Houston Shopper Sues Grocery Chain Fiesta Mart Over Slip-and-Fall Incident

In a dramatic turn of events, a Houston resident has taken legal action against a prominent grocery chain, alleging negligence that resulted in severe personal injuries. Julia Garcia filed a complaint on April 9, 2025, in the District Court of Harris County, Texas, targeting Fiesta Mart, L.L.C., for an incident that occurred at one of its locations.

According to the lawsuit filed by Garcia's attorney Ryan D. Havins from The Havins Law Firm, L.P., the incident took place on April 22, 2023, at Fiesta Mart #7 located at 6200 Bellaire Blvd., Houston. Garcia claims she slipped on an unidentified black substance on the floor which led to injuries affecting her mid and lower back, left arm, hip/pelvis area, and left leg. The petition asserts that these injuries were directly caused by Fiesta Mart's negligence in maintaining safe premises for its customers.

Garcia's complaint details several allegations against Fiesta Mart including failure to adequately warn of dangerous conditions and neglecting to correct such hazards despite being aware or should have been aware of their existence. "The Defendant failed to use any warning signs," states the petition, emphasizing that no warnings were present in the aisle where Garcia fell. The lawsuit argues that as an invitee, Garcia was owed a high duty of care by Fiesta Mart to protect her from unreasonably dangerous conditions.

The legal filing further accuses Fiesta Mart of gross negligence under Chapter 33 and Section 41.001(11) of the Texas Civil Practice & Remedies Code. It highlights how the store's actions or lack thereof exhibited conscious indifference towards the safety and welfare of others including Garcia herself.

Garcia is seeking monetary relief not exceeding $250,000 excluding interest and other costs as specified under TRCP 47(c)(1). She aims to recover damages for past and future medical expenses, physical pain and suffering endured both previously and prospectively as well as mental anguish among other compensations. Additionally requested are court costs along with pre-judgment and post-judgment interest calculated per Texas Finance Code provisions.
