Motorcyclist claims defective rear tire caused his I-45 crash

HOUSTON — A motorcyclist claims a defective rear tire caused him to crash into a concrete barrier on Interstate 45 in Houston. 

Daniel Infante filed a complaint July 21 in Harris County District Court against J&D Cycles LLC alleging negligence. 

According to his complaint, Infante was driving his Harley Davidson on Interstate 45 in Houston on Nov. 5, 2020. He claims his motorcycle suddenly went into an uncontrollable "wobble" due to a defective rear tire and installation of the tire. Infante alleges he lost control of the motorcycle and struck a concrete barrier which caused him to suffer serious injuries. He claims that 14 days prior to his accident, he had purchased the tire from J&D Cycles who also mounted and installed the tire on his motorcycle. 

Infante alleges that J&D Cycles was negligent for failing to properly inspect the tire, failing to properly service and maintain the tire and for failing to warn of the "open, obvious and/or concealed dangers" of the tire. He also alleges J&D was negligent for failing to train it staff with regard to the sale, installation, inspection, service and maintenance of the tire. Infante claims as a result of the accident, he suffered loss of earnings, physical disfigurement and incurred medical expenses. 

Infante seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Jason Webster, Hedi Vicnair and Christian Tovar of The Webster Law Firm in Houston and Jon Alworth of The Alworth Law Fir in Houston.
