Couple alleges pool contractor paid more than $160,000 failed to complete project

HOUSTON — A couple allege a pool contractor they paid more than $160,000 failed to complete the project. 

Fredrico Sheffield and Sybill Kyle filed a complaint July 25 in Harris County District Court against Palm Pools and Troy D. Montgomery alleging violation of the Texas Deceptive Trade Practices Act, fraud and other claims. 

According to their suit, the plaintiffs contracted with Palm Pools for a custom-designed pool, spa, spray deck and concrete, grass and sprinkler repair, a sidewalk, mosquito mist system and an outdoor kitchen. They allege that the defendants failed to implement changes and upgrades on the project, failed to clean and clear the construction site of debris and materials and did not complete the outdoor kitchen. 

The plaintiffs also allege that the defendants did not install the outdoor kitchen appliances, did not connect the natural gas plumbing and failed to complete the pool fountain/water feature. They allege the plaintiffs also failed to install numerous other parts of the project including operable spa jets and a pool heater and electrical plugs outlets. 

The plaintiffs also allege they paid the defendants the total balance of $166,950 including $45,000 for phase completion, yet the defendants breached the contract by failing to complete the work. They claim the defendants also violated the Deceptive Trade Practices Act by engaging in false and misleading practices. 

The plaintiffs seek monetary relief between $200,000 and $1 million, interest and all other just relief. They are represented by Paige Lockett of The Law Office of Paige J. Lockett PLLC in Houston.
