Suit: Software company fraudulently sold products to Harris County business owner

HOUSTON — The owners of several car washes and oil change establishments allege they were fraudulently sold business software. 

Mohsin Qayyum and Dr. Car Wash Plus LLC filed a complaint July 25 in Harris County District Court against MAM Software Inc., alleging breach of contract, violation of the Texas Deceptive Trade Practices Act and other claims. 

The plaintiffs, according to their complaint, operate car washes and oil change businesses and entered into a contract with MAM Software in March of 2020. They allege that the defendants assured them the software would help with auto repair programming and guide technicians through the repair process. 

They also allege the software was supposed to help with inventory control and have software training for its technicians as well as would have customizable programming to fit its company's needs. The plaintiffs claim that they could not use the software because the system would repeatedly crash with no technical support assistance being available from MAM. In addition, the plaintiffs claim in their suit that MAM's software products were unworkable and when they attempted to terminate the contract with MAM, the defendant's employees refused to end the five year agreement. They further claim they paid MAM each month for a total of $35,256 despite the defendant's breach of contract. 

The plaintiffs seek monetary relief between $100,000 and $200,000, interest and all other just relief. They are represented by James Overstreet of J. Nathan Overstreet & Associates PC in Houston.
