Bouncer at Galveston bar allegedly assaulted patrons, suit claims

GALVESTON — Patrons of a bar in Galveston are alleging they suffered injured after being assaulted by a bouncer. 

Alvaro Ivan Alvarez and Herminia Delgado filed a complaint Aug. 1 in Galveston County District Court against Island Famous Inc., doing business as The Spot, alleging negligence. 

According to their complaint, the plaintiffs were at the The Spot restaurant on Seawall Boulevard in Galveston on July 23, 2022. They allege that as they left the restaurant, the bouncer "suddenly and violently" began to attack them followed by police handcuffing and detaining them for alleged public intoxication. The plaintiffs claim The Spot's negligence for failing to properly train its staff on avoiding using excessive force and for failing to screen and supervise its employees. 

They further claim The Spot failed to monitor security cameras and properly respond to disruptive behavior in the bar. The plaintiffs allege The Spot was also negligent for failing to prevent customers from being injured or use ordinary care and prudence under the circumstances. They also allege as a result of the attack, they suffered physical pain, impairment, disfigurement along with mental anguish. 

The plaintiffs seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Mathew Mendoza and W. Clark Martin IV of the Martin Law Firm PLLC in Houston.
