Woman who slipped on ice patch during freeze sues Houston restaurant

HOUSTON — A woman who slipped on an ice patch at a restaurant in Houston during the state's winter storm of 2021 is claiming negligence. 

Monica Lopez filed a complaint  Aug. 29 in Harris County District Court against Deemark LLC doing business as Thai Spice Asian Cuisine and AP Houston Heights Marketplace LLC alleging negligence. 

Lopez alleges that while on the defendants' property on West 19th Street in Houston in February of 2021, she slipped on an ice patch and suffered injuries. She alleges that following a major Artic cold front that hit the state that brought snow, sleet and freezing rain, the defendants opened their doors for business. Lopez further alleges that the defendants failed to take safety precautions to remove or warn of the ice that had accumulated at the main entrance and that they knew or should have known of the danger. 

She claims as the owner of the strip center, AP Houston Heights, had a legal duty to protect invitees from danger. Lopez alleges as a result of her fall, she suffered impairment, mental anguish, lost earnings, disfigurement and incurred medical treatment costs. 

Lopez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Richard Hinojosa and Justin Burrow of Hinojosa Law PLLC in Houston.
