GALVESTON — The wife and children of a AC technician who died from electrocution is claiming wrongful death against his former employer.
Eileen Perez, individually and as representative of the Estate of Pat Perez and as next friend of J.X.P., A.L.P., M.A.P., and A.R.P., minors filed a complaint Aug. 31 in Galveston County District Court against BMS Construction LLC alleging negligence and wrongful death.
According to the plaintiffs' complaint, Pat Perez was working as a heating, ventilation and air conditioning specialist at a property in Bacliff Texas on Aug. 25, 2022. They claim that as Perez was connecting the HVAC unit, he came in contact with an unmarked and unsecured element that was not in a protective enclosure and suffered a fatal electrocution. The plaintiffs allege Perez was wearing personal protective gear and that BMS Construction was negligent for failing to train or supervise its employees.
They also allege BMS' negligence for failing to provide Perez with adequate instructions or have adequate safety polices and procedures or equipment. The plaintiffs claim BMS was negligent for failing to warn Perez of the danger of energized equipment and for failing to communicate with the electrical company utility or contractors. They further claim BMS violated OSHA, National Electric Code and National Electrical Safety Code regulations and did not reasonably inspect the work area or equipment.
The plaintiffs seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Jeffrey McCarthy and Mike Takla of McCarthy & Associates PLLC in Houston.
