HOUSTON — The mother of a tow truck driver who was struck and killed on Northwest Freeway in Houston is claiming his former employer's liability.

Susan D. Harris as heir and wrongful death beneficiary of Timothy Perkins and on behalf of all wrongful death beneficiaries, filed a complaint  Sept. 12 in Harris County District Court against All American Towing and Transport LLC and Houston Emergency Auto Rescue & Trucking LLC alleging liability.

According to Harris' complaint, her son Timothy Perkins, a tow truck driver, was standing on the right-hand shoulder of Northwest Freeway in Houston on Jan. 22, 2022. She claims an "unknown driver" failed to drive in a single lane and fatally struck Perkins. Harris further claims the defendants failed to properly supervise or train their driver and did not properly maintain mechanical defects with their commerical vehicle. She alleges that as a result of her son's wrongful death, she has been deprived of her son, incurred medical expenses and suffered mental anguish.

Harris seeks monetary relief of $10 million, interest and all other just relief. She is represented by Ashley Tizeno  and Brenna Sanchez of The Dunk Law Firm in Houston.
