Couple alleges home's construction defects led to mold issues

GALVESTON — A couple allege their Taylor Morrison home built in League City had moisture and mold issues.

Wayne Sutherland and Terri Sutherland filed a complaint Sept. 7 in Galveston County District Court against Taylor Morrison of Texas Inc., and Taylor Woodrow Communities - League City LTD., alleging negligence, breach of contract and other claims. 

According to their complaint, the Sutherlands purchased a home built by the defendants in the Mar Bell development in League City. The Sutherlands claim that construction defects with the home have caused excessive moisture, humidity, mold growth and mycotoxins to their home as well as in numerous other properties in their neighborhood. 

They further claim the defendants knew of the moisture problems and that on Oct. 27, 2020, they were provided with a certificate of mold damage remediation, however the defendants' "limited" repairs failed to address and fix all the mold problems. The Sutherland's claim the defendants were negligent for failing to properly design, construct and inspect the home's roof, attic, windows, HVAC system, showers and other areas to remediate the defective conditions. They also claim the defendants did not give adequate warnings and violated building codes and manufacturers' requirements. 

The Sutherlands seek monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. They are represented by A. Craig Eiland of Eiland & Bonnin PC in Galveston, Shaun Hodge of The Hodge Law Firm PLLC in Galveston and Dax Faubus of The Faubus Firm in Houston.
