Customer alleges recently painted ramp at Houston Cheddar's caused his fall

HOUSTON — A customer alleges a recently painted wheelchair ramp at Houston restaurant caused his fall. 

Abraham Nino filed a complaint Oct. 12 in Harris County District Court against Cheddars Casual Café, Inc, USA Construction and Project Management Exchange LLC and Walter Thompson, doing business as Texas Parking Lot Maintenance, alleging negligence and premises liability. 

According to his complaint, Nino and his family were at Cheddar's in Katy on Dec. 31, 2020, for a New Year's dinner. He claims as they came out of the restaurant towards the sidewalk, he slipped and fell violently down on the concrete while walking down a ramp. Nino further claims it had been raining earlier in the day and the paint used by USA Construction and Thompson on the ramp made it "highly slick." 

He alleges Cheddar's negligence for failing to maintain the restaurant's walking area in a reasonably safe manner and for failing to warn of the danger. Nino also alleges that the hazard was a reasonably discoverable dangerous condition which they failed to correct. He claims as a result of his slip and fall, he suffered pain, impairment, lost wages and incurred medical expenses. 

Nino seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Marcus Spagnoletti and Edward Keenan of The Spagnoletti Law Firm in Houston.
