Woman claims gap in pavers caused her ankle fracture at Texas Renaissance Fair

HOUSTON — A woman alleges she suffered an ankle fracture after tripping on pavers at the Texas Renaissance Fair. 

Tammy Russ  filed a complaint Oct. 16 in Harris County District Court against Texas Renaissance Festivals LLC alleging premises liability and negligence. 

Russ alleges in her complaint that she was at the Renaissance Festival on Oct. 31, 2020. She claims as she walked through an area of pavers on her way to the restroom, her shoe became "ensnared" in one of the large gaps between the papers. Russ further claims she lost her balance and fell "violently" to the ground and suffered a complex fracture on her ankle. 

She alleges the defendants' negligence for failing to detect the presence of gaps in the pavers near the restroom, failing to inspect the pavers and performing standard maintenance on the pavers which would have uncovered the gaps. Russ also alleges the defendants did not provide a safe festival environment and that employees walked through the area prior to her accident and ignored the presence of the gaps which were a tripping hazard. She claims as a result of her fall, she also suffered disfigurement, impairment and monetary damages.

Russ seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Kenneth Baird of The Baird Law Firm in Houston.
