Subcontractor allegedly slips on gravel covering oil spill at Shell facility, seeks up to $1M in damages

HOUSTON — A subcontractor working at a Shell Oil facility is claiming negligence after slipping on gravel that was used to cover oil on the ground.

James Halliburton and Deborah Halliburton filed a complaint Nov. 8 in Harris County District Court against Shell USA Inc., alleging negligence. 

Halliburton, according to his complaint, was working for Sage Eviro Tech as a safety coordinator at Shell Oil's facility in Deer Park on Aug. 8, 2022. He claims he was walking on "pea gravel" that was on the ground to cover oil. Halliburton further claims he then stepped up on a concrete platform when his leg slipped onto the pea gravel and caused him to fall backwards and land on his tailbone and upper back. 

Halliburton alleges Shell failed to keep their premises safe, failed to eliminate the unreasonable risk of harm and did not warn of the hazard. He also alleges Shell failed to inspect its premises or supervise, train and monitor its employees' work and safety performances or that of its subcontractors. Halliburton claims as a result of his fall, he suffered impairment, disfigurement, lost wages and incurred medical bills and expenses. 

Halliburton seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Scott Sanes of The Sanes & Larkin Law Firm LLP in Pearland.
