Buc-ee's customer alleges he slipped on fuel spill, sues for $1M

HOUSTON — A customer who allegedly slipped on a fuel spill at a Buc-ee's in Baytown is claiming negligence.

Roy Rodriguez filed a complaint Nov. 7 in Harris County District Court against Buc-ee's LTD alleging negligence.

Rodriguez, according to his complaint, was pumping gas at the Buc-ees in Baytown on March 13, 2021. He claims that he slipped on spilled fuel and suffered damages including impairment, pain, mental anguish, lost wages and incurred medical treatment expenses. 

Rodriguez claims Buc-ee's negligence for failing to inspect its premises, correct and warn of the dangerous condition and failed to train its employees to maintain a hazard free environment. He also claims Buc-ee's negligence for failing to clean the spilled fuel from the premises and failed to exercise ordinary care to eliminate the risk. 

Rodriguez seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Aaron Genthe and Rebecca Rutan of The Genthe Law Firm PC in Dallas.
