Subcontractor alleges unsecured manhole cover caused his injuries

GALVESTON — A subcontractor alleges a plant owner's failure to safely secure a manhole cover caused his serious injuries. 

Rayford Garcia filed a complaint Nov. 17 in Galveston County District Court against Ineos Ican Foundation alleging negligence. 

Garcia, according to his complaint, was working for Zachary at the Chocolate Bayou plant owned by Ineos on March 30, 2022. He claims that Ineos had issued a work permit to Zachary but failed to provide a safety bolt/nut on the top of a manhole cover to keep it from falling. Garcia alleges that when he went to loosen the manhole cover, it fell and struck him on his foot and caused him serious injuries. 

He claims Ineos' negligence for creating the dangerous condition, failing to inspect the premises and for failing to warn of the dangerous condition. Garcia also claims Ineos was negligent for failing to supervise and train its employees and monitor the work and safety performance of its employees and subcontractors. He alleges he has suffered pain, impairment, disfigurement, lost wages and incurred medical expenses as a result of the accident. 

Garcia seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief.  He is represented by Scott Sanes of The Sanes & Larkin Law Firm LLP in Pearland and Robert Rice of The Rice Law Office in Angleton.
