Woman files lawsuit against River Oaks at MLK claiming that lack of proper security led to shooting death of her husband

HOUSTON – A woman has filed a lawsuit against River Oaks at MLK following the shooting death of her husband on the business' premises.

Plaintiff Connie Dervin, as beneficiary of Patrick Mitchell, filed a wrongful death lawsuit in the Harris County District Court against River Oaks at MLK, LLC, citing negligence.

According to the lawsuit, on Feb 7. 2021, Mitchell was a patron at the premises owned by the defendant. The lawsuit states that while Mitchell was on the premises, he was the victim of a shooting and killed. 

The plaintiff alleges that the business is in a high crime area, but despite this, the defendants failed to provide adequate security to provide a safe area and protect the safety of its patrons. 

Dervin claims that as result of the defendant's negligence she has been made to suffer grief, bereavement, mental anguish and the loss of Mitchell's consortium. 

The plaintiff is seeking damages in excess of $1,000,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorneys Brent M. Cordell and Antone L. Peterson of Smith & Hassler in Houston.
