Man alleges Nissan Sentra had defects including smoking from alternator

GALVESTON — A Texas man alleges his 2021 Nissan Sentra suffered from numerous defects including a faulty transmission. 

Thomas Wayne Holcomb filed a complaint Dec. 6 in Galveston County District Court against Nissan North America Inc., alleging breach of written warranty and breach of implied warranty. 

According to his complaint, Holcomb purchased a 2021 Nissan Sentra in May of 2021. He claims that shortly after purchasing the Sentra, he noticed defects that included a faulty transmission, steering wheel shaking when applying brakes and smoking due to the alternator shortening out. Holcomb alleges that he gave an authorized dealer sufficient opportunities to repair the Sentra but failed to fix the defects. 

He further alleges that he purchased the vehicle for $42,071.88 and that the Sentra had a three year or 36,000 mile bumper to bumper and five year or 60,000 mile powertrain warranty. He claims that as a result of the car's defects, he has suffered financial damages including costs of repairs and that Nissan's actions violated the Magnuson-Moss Warranty Act. 

Holcomb seeks monetary relief of $250,000 or less, interest, trial by jury and all other just relief. He is represented by Andrew Bandzar of The Consumer Protection Law Group in Phoenix, Arizona.
