Houston woman alleges mold remediation company violated FHA

HOUSTON — A Houston woman with a disability alleges a mold remediation company failed to perform the proper work on her home damaged by Hurricane Harvey in violation of the Fair Housing Act. 

Sherry Samuels filed a complaint Dec. 12 in Harris County District Court against Horne LLP and Ducky Recovery LLC alleging violation of the Fair Housing Act and other claims. 

Samuels, a disabled African American female, alleges in her complaint that her home in Houston was uninhabitable for two years due to flooding from Hurricane Harvey in 2017. She further alleges she suffers from "debilitating allergic reactions and hypersomnia" from severe asthma attacks and could not live in her home due to mold spores from water intrusion in the roof and behind the walls. 

Samuels claims she suffered health consequences from the mold spores in her home and that mold testing done in July of 2019, showed high spore counts. She alleges Ducky's remediation work was defective and failed to have protection against future moisture accumulation and that the defendant refuses to do the additional work for her to safely return to her home. Samuels claims Ducky's actions violated the FHA due to their refusal to make reasonable accommodations and perform the necessary work so that she may return to her home. 

Samuels seeks monetary relief between $250,000 ad $1 million, interest trial by jury and all other just relief. She is represented by S. Tomiyo Stoner of The Undaunted Law Firm PC in Dallas.
