Tenant alleges poor security led to his stabbing at apartment complex

HOUSTON — A Houston man is alleging the owners of his apartment complex knew of criminal activity in the area and failed to have proper security, which led to his being stabbed. 

Dallas Toussaint filed a complaint Dec. 23 in Harris County District Court against Premier on Woodfair LP, Woodfair Community Development LLC, Westwood Foundation Inc., and Woodfair Apartments LLC alleging premises liability, 

Toussaint, according to his complaint, was residing at the Woodfair Apartments on Woodfair Drive in Houston. He claims that on July 30, 2022, he was attacked by another resident and stabbed five times with a large knife. Toussaint claims that prior to his attack, Woodfair residents reported violent criminal activity to the defendants and that the defendants were aware of the risks and failed to warn residents. 

He further claims the defendants had lack of adequate security on the apartment complex premises and allowed individuals who had committed criminal acts inside the apartment complex. Toussaint alleges the defendants negligently failed to take any meaningful steps to deter crime or secure the apartment complex. Among Toussaint's other claims in his suit is that the defendants also violated the Deceptive Trade Practices Act by representing that the apartment complex had adequate security.  

Toussaint seeks monetary relief of more than $10 million, interest, trial by jury and all other just relief. He is represented by Taft Foley II of The Foley Law Firm in Houston.
