Total Wine customer alleging injuries from falling boxes sues for $1M

HOUSTON — A customer at a wine shop alleges she was injured after boxes fell off a shelve and struck her in the head. 

Nancy Talkington filed a complaint Dec. 22 in Harris County District Court against Fine Wines & Spirits of North Texas LLC, doing business as Total Wine & More and Retail Services & Systems Inc., alleging negligence and other claims. 

Talkington, according to her suit, was at Total Wine & More on Holcomb Boulevard in Houston on Oct. 4, 2022. She claims that she was stopped on an aisle when an employee stocking shelves on an aisle on the other side pushed a box off the top shelf which fell and struck her on the head. 

Talkington alleges the defendant's negligence for failing to properly train its employees and failing to stock items and goods in a safe manner. She also alleges the store failed to warn of the danger or implement adequate customer safety programs to protect invitees in the store. 

Talkington claims as a result of the accident, she suffered pain, anxiety, impairment, disfigurement and incurred medical costs. 

Talkington seeks monetary relief of more than $1 million, interest and all other just relief.
