HOUSTON — A restaurant worker who slipped in a kitchen freezer and suffered severe injuries is claiming negligence.
Micaela Martinez filed a complaint Jan. 2 in Harris County District Court against Iguana Joe's Crosby Inc., alleging negligence.
According to her complaint, Martinez was working as a cook at Iguana Joe's restaurant on Farm To Market 2100 Road in Crosby on Oct. 16, 2022. She claims that as she entered the kitchen freezer, she slipped on a "slick/slippery floor" and onto her back. Martinez alleges the freezer floor was not slip resistant and that the defendant failed to comply with applicable safety standards.
She also claims the defendant was negligent for failing to properly supervise and train its employees or have adequate safety equipment. Martinez alleges the defendant was also negligent for failing to maintain and keep the workplace free from hazards and were in violation of OSHA safety rules. She claims she suffered impairment, mental anguish, disfigurement and lost earnings. Martinez further claims as a result of her fall, she incurred medical treatment expenses.
Martinez seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Sarah Y-Nhi Huynh, Pavel Savinov and Michael Alvarez of the Huynh Law Firm PLLC in Houston.
