Suit: Apartment tenant shot after complaining about neighbor's loud music

HOUSTON — A woman alleges she was shot by her neighbor at a Houston apartment complex after complaining about loud music. 

Ana Caal-Coy filed a complaint Jan. 2 in Harris County District Court against Victory Apartments Inc., alleging negligence. 

The plaintiff, according to her complaint, was at her apartment on Beatty Street in Houston on Nov. 21, 2021. She claims that after complaining about loud music coming from one of her neighbors, the neighbor began choking her son and then shot her in the leg. The plaintiff alleges the defendant was negligent for failing to properly control the safety of the apartment complex and failing to evict unruly tenants. 

She also alleges the defendants failed to handle tenant complaints about other dangerous tenants or dangerous situations and suspicious activities. The plaintiff alleges the defendant's negligence for failing to warn of the dangerous situations and crime in the complex and for accepting tenants with a criminal history and failing to prevent illegal firearm possession on the premises.  

She claims she suffered lost wages, impairment, disfigurement, lost wages and incurred medical expenses as a result of her injuries. 

The plaintiff seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Annie Basu and Dan Pena of The Basu Law Firm PLLC in Houston.
