Suit: Tenant suffers smoke inhalation, property damage after apartment fire

HOUSTON — A tenant is claiming negligence after a apartment complex fire destroyed her property and caused her to suffer smoke inhalation. 

Brittany Dudley filed a complaint Jan. 16 in Harris County District Court against Simfa Stonecrossing partners LLC and Comunidad Realty Partners Management LLC alleging negligence. 

Dudley alleges in her complaint that on Aug. 30, 2021, a fire started at a neighboring apartment complex on Elmside in Houston. She claims the fire spread throughout her apartment complex, caused her property to be severely damaged and caused her to require treatment for smoke inhalation. 

Dudley claims the defendants' negligence for failing to provide a safe living area and for failing to maintain and monitor its premises for any hazardous conditions. She further claims their negligent acts caused her to suffer property damage, physical pain, mental anguish, lost earnings, impairment and to incur medical treatment expenses. 

Dudley seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Joshua Leske of Husain Law + Associates PC in Houston.
