HOUSTON — A homeowner alleges a kitchen and bath remodeling contractor failed to complete a project despite being paid more than $50,000.
Milagro Ayala filed a complaint Jan. 23 in Harris County District Court against Hadad Design and Construction doing business as Kitchen & Bath Decor & More and Celeste Haddad alleging breach of contract, negligent misrepresentation, fraud, violation of the Texas Deceptive Trade Practices Act and other claims.
Ayala, according to the complaint entered into a contract with Kitchen & Bath Decor for a home remodel at the plaintiff's residence in Stafford in December of 2021, for a contract price of $53,400. Also according to the complaint, the defendants "fraudulently" induced Ayala into a loan financing agreement for $23,400 with Ayala paying an additional $30,000 in cash to Kitchen Bath Decor.
Ayala claims approximately one year later, Kitchen & Bath Decor has performed only minimal demolition work and has failed to deliver any of the goods or materials paid for under the contract. The plaintiff alleges that the home is "in worse condition" despite the defendants receiving $53,400 and that they negligently misrepresented they had the experience and skills to provide qualified labor for the project.
Ayala seeks monetary relief of $250,000 or less, interest and all other just relief. The plaintiff is represented by Tod Colvard of The Colvard Law Group PC in Houston.
