Suit alleges nursing home's improper care led to resident's death

HOUSTON — A woman claims improper care led to her husband nursing home death.

Joyce Brown, individually and on behalf of the Estate of John Brown, filed a complaint Jan. 29 in Harris County District Court against Baytown Transitional Care Center LLC doing business as St. James House of Baytown alleging medical negligence and other claims. 

According to Brown's complaint, her husband John Brown was a resident of St. James House from June 5, 2022 to June 10, 2022. She claims he suffered from dysphagia, muscle weakness, was on supplemental oxygen and other medical conditions which put him at increased risk of aspiration. Brown alleges that on May 22, 2022, her husband was experiencing shortness of breath and developed pneumonia and that in June of 2022, he suffered a choking incident. 

She further alleges that also in June of 2022, her husband had respiratory failure and was readmitted to Houston Methodist Hospital on multiple occasions. Brown claims on June 10, 2022, he was found non responsive in his bed and died from pneumonia, aspiration bronchiolitis and that aspirated food material was shown in his alveoli. She alleges the St. James House failed to reasonably care for her husband and failed to train or supervise its staff which led to his neglect and death. 

Brown seeks monetary relief, interest and all other just relief. She is represented by Curtis Clinesmith and David Smith of Smith Clinesmith LLP in Dallas.
