GALVESTON — A homeowner alleges a roofing contractor failed to fix deficiencies with his new roof including missing nails and trusses.
Robert Lynch filed a complaint Feb. 3 in Galveston County District Court against Morgan Roofing LLC alleging breach of contract, violation of the Deceptive Trade Practices Act and other claims.
Lynch alleges in his complaint, that through his contractor, he entered into a contract with Morgan Roofing for the removal and replacement of his roof at his property on 27th Street in Galveston. He claims after the roof was installed, his contractor paid Morgan Roofing $13,556 on his behalf on Dec. 9, 2021. Lynch alleges that there were "obvious" deficiencies with the roof including missing nails and trusses.
Specifically, Lynch alleges over 100 nails were driven but did not go through into the trusses as well as missing hurricane clips. Lynch claims a professional engineer's inspection of the roof showed a need to remove the asphalt shingle roofing and underlayment to inspect the deck fastening. He further claims the defendant has failed to make the repairs or refund the original cost of the roof.
Lynch seeks monetary relief, interest, trial by jury and all other just relief. He is represented by S. Benjamin Shabot of Beeton Shabot LLC in Galveston.
