Suit: Worker required emergency back surgery after fall from scaffold

HOUSTON — A worker who fell off a scaffold at a job site in Harris County and required emergency back surgery is claiming negligence. 

Manuel Hernandez filed a complaint Feb. 17 in Harris County District Court against Systematic Contractors LLC alleging negligence. 

Hernandez was working on a remodeling project site in Harris County on Nov. 22, 2022, according to his complaint. He claims he was placing ceiling tiles while on top of a scaffold, when the scaffold which had no guard railing, shifted and caused him to fall to the ground below. Hernandez claims as a result of his fall, he required emergency back surgery. 

He alleges the defendant's negligence for failing to make safety inspections on the site, failing to retain control over the work and for failing to warn or provide him with proper supervision and training. He also alleges the defendants were negligent for failing to have effective equipment and providing a safe place to work. 

Hernandez seeks monetary relief, interest, trial by jury and all other just relief. He is represented by. J. Moises Cedillos of The Cedillos Law Firm PLLC in Houston.
