Retail tenant faces suit over alleged failure to pay rent, fees

GALVESTON — A former Gulfway Plaza in La Marque tenant is facing a claim it failed to pay their rent and other fees according to their lease. 

La Marque Outlet Development LP filed a complaint Feb. 15 in Galveston County District Court against Derick Burby, doing business as Basemint Training Center LLC, alleging breach of contract.

According to La Marque Outlet's complaint, they entered into a lease agreement with the defendant in August of 2019, for a 2,400 square foot building space at Gulfway Plaza in La Marque. They claim the lease expired on Dec. 31, 2022, and that the defendant has failed to pay the rent and other amounts under the lease. La Marque Outlet alleges they have made several demands for payment and that Basemint Training Center is in breach of contract. 

La Marque Outlet seeks monetary relief, interest and all other just relief. They are represented by Brian Clark of Kane Russell Coleman Logan PC in Dallas.
