GALVESTON — A nursing home is being blamed for a resident's death due to falls, malnutrition and other neglect.
Elsa Gracia, individually and as the proposed administrator of the Estate of Consuelo Lujan filed a complaint Feb. 16 in Galveston County District Court against The Villa Del Mar at Mainland Center LLC, doing business as The Rio At Mainland Center, and others alleging neglect and other claims.
Gracia claims Lujan became a resident of The Rio at Mainland Center on May 15, 2015 for long term care due to dementia, falls, cognitive impairment and weakness. She claims Lujan suffered seven falls while at the facility because the defendants failed to properly supervise her and due to a lack of adequate staffing.
Gracia also claims the staff at The Rio allowed Lujan to become dehydrated and failed to provide her with proper nutrition which caused her hospitalization. She alleges that Lujan was also forced to utilize a feeding tube and was not repositioned enough which resulted in repeated dislodging of her tube as well as was forced to bathe herself. Gracia claims the defendants' neglect of Lujan led to her injuries and death.
Gracia seeks monetary relief, interest and all other just relief. She is represented by Jacqueline Stump and Kevin Cos of McDonald Worley PC in Houston.
