Beverage delivery driver sues employer after serious back injury

HOUSTON — A beverage delivery driver is claiming negligence against his employer after suffering a serious on the job back injury. 

Brandon Finely filed a complaint Feb. 24 in Harris County District Court against Silver Eagle Distributors LLC alleging negligence. 

Finely alleges in his complaint that he was working as delivery route driver for Silver Eagle on Aug. 12, 2022 in Harris County. He claims his job entailed lifting an average of 1,400 large cases of beverages per day. He claims that in December of 2021, he initially injured his back and required emergency medial care and that in August, he was severely injured while lifting cases into a convenience store. 

Finely further claims that he injured his back, leg and foot and required surgery for his back. He alleges the defendants did not provide him with safety equipment, or safe-lifting training and that the the defendants failed to warn him or comply with OSHA guidelines. According to Finely's complaint, Silver Eagle is a non-subscriber to Workers' Compensation. 

Finely seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Kurt Arnold, Caj Boatright, Roland Christensen and Alex Paradowski of Arnold & Itkin LLP in Houston.
