Holiday Inn guest claims curled up mat caused his fall, sues for $1M

GALVESTON — A guest at a Holiday Inn in Galveston claims a curled up mat caused his fall and injuries. 

Rogelio Rivera filed a complaint March 7 in Galveston County District Court against Island Hospitality Inc., Landry's Acquisition Co., Landry's Restaurant's Inc., Intercontinental Hotels Group Resources Inc., and Elaut USA Inc., alleging negligence. 

Rivera, according to his complaint, was a guest at the Holiday Inn Resort in Galveston on April 15, 2021. He claims he slipped and fell because of a "wet and disheveled" mat that was placed and curled up on one side. Rivera alleges he fell forward and struck his face and forehead on the wall and then fell to the ground. 

He claims the defendants' negligence for failing to eliminate the dangerous condition, failing to properly maintain and place the floor mats and failing to properly train their employees. 

Rivera further claims the defendants were negligent for failing to warn of the hazard or inspect its premises for dangerous conditions that may cause injury. 

Rivera seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Sofia Bruera of The Bruera Law Firm PLLC in Houston.
